According to the International Chamber of Commerce (ICC) recently released revisions to the standard trade definitions known as Incoterms, F.O.B means Free on Board. In 2010, the ICC altered the definition to state the seller must load the goods on board the vessel importa nominated by the buyer. The cost and risk are divided when the goods are actually on board of the vessel (this rule is new!). The seller is responsible for the goods to be cleared for export. importa The term is applicable for maritime and inland waterway transport only but NOT for multimodal sea transport in containers. The buyer must instruct the seller the details of the vessel and the port where the goods are to be loaded, and there is no reference to, or provision for, the use of a carrier or forwarder. When developing any business agreement, the buyer should seek to specify in the contract of sale what specific costs will be borne by the seller and what costs by the buyer to avoid a dispute in the future. According to the new rules established by the ICC, where the buyer has given an indication as to the loading point but later wants to change these instructions, the seller is not obliged to cover the expenses of transferring the goods to a new loading point, provided the seller has acted in line with the buyer s first instructions and the buyer s new notice has arrived too late for seller importa to comply with it without extra cost. It is essential importa in the contract to make it clear when ownership passes from the seller to the buyer.
Each situation differs depending on place, parties, industry, applicable laws and relevant customs importa and usages, so general guidance cannot be expected to determine an outcome in a dispute. Incoterms are nothing but some International Commercial terms published by International Chamber of Commerce to clearly communicate the associated risks,costs,tasks etc. evolved with international procurement and logistics. Which are widely accepted by legal authorities, governments and involved dubai duty free parties with the commercial  transactions .
Incoterms usually help to reduce uncertainties and for that reason dubai duty free are incorporated in Letter of Credit, Sales Contract etc. in the whole world. Incoterms are last amended/published by ICC on January 01, 2013.Some essential incoterms are highlighted below:

While using the incoterm FCA , the Seller agrees to give delivery of the goods into the custody of the forwarder, freight forwarder etc. who are usually  nominated by Buyer.The Sales Contract or Letter of Credit must state clearly the place or to which people the cargo would be dlivered.
After hand over the cargo to that place or people buyer is responsible for loss or damage of the goods. Under the buyer’s Ocean Cargo Insurance Policy, insurance would cover as the goods are delivered to the carrier. It is in the buyer’s interest to review the insurer’s country exposure.
The incoterm FOB is from the point of delivery of goods and transfer of risk, it starts with the goods pass the ship’s rail at the named port of shipment. Responsibility of goods transferred to the Buyer from the Seller when goods cross the rail of the ship.
Except  CIP and CIF , incoterms do not have any obligation on the Seller and Buyer to provide insurance. But at some point, either Buyer or Seller dubai duty free bears the responsibility for loss to the goods during transit.
In context dubai duty free of Bangladesh Exporters, Bangladesh Bank has ordered the enlisted banks and foreign currency handling institutions to use Incoterm FCA instead of FOB while they had over cargo to buyer nominated forwarder/carrier. Bangladesh Garments Manufacturers andExporters Association have advised its members to comply with the Bangladesh Bank advice by a circular dated January 01, 2013.
They hope that it will help Exporters/Sellers in Bangladesh Garment industries to get coverage of Insurance Policy of Buyers. And they do not pay additional charges, such as Terminal Handling Charges.

Group 1 = the “E” or Ex Works.  The seller only makes the goods available to the buyer at the seller’s own premises.
Group 3 = the “C” or Cost, Insurance, and Freight.  The seller has to contract for carriage, but without assuming the risk of loss of or damage mk908 to the goods or additional costs due to events after shipment and dispatch.
The most common terms are EXW (Ex Works), FCA (Free Carrier to the named place), FOB (Free on Board), and DDU (Delivery Duty Unpaid).  In my experience, buyers mk908 would seek agreements for EXW or FOB.  EXW has the minimum obligation for the seller with the buyer taking on the most responsibility.  The seller is not responsible for loading the goods if it is not agreed in contract of sale.  This is common mk908 for large global organizations with a sophisticated supply chain.   They most likely have local partners or divisions in place to pick up the goods and get them to the nearest port of export.  The other is FOB, where the seller delivers the goods at the named loading port.  This is common for organizations that have refined supply mk908 chain in their local country and can get the goods to the destination manufacturing mk908 facility once delivered to the destination port.  Documentation must be presented to customs in the country of destination with full details, ex. FOB Shanghai.  All of these terms influence price both from a logistics and administrative standpoint.  Imagine how much less expensive a final cost of a product is for a buyer if the last step for the seller was to get the finished goods to their dock at the end of the facility (EXW).  There are added costs once the seller has to transport the goods to the port of export (FOB).
If you were the buyer in charge of a large global distributor of goods, mk908 which would you pick?  It depends on the country you are dealing with and if you have a local partner/division for assistance.  Most of my projects were FOB, so the buying mk908 organization only had to hold the risks and responsibility of transporting the goods from the destination port to their facility.  They were OK with the seller figuring out and adding in the costs from the facility to the export port.

Of the three terms contained within the F group two are intended for use only when the goods are carried by sea (but not containerised freight) or inland waterway transport, the other one FCA(Free Carrier … named place) is intended for use by any mode of transport.
This differentiation between terms intended export manager for one mode of transport rather than another leads to difficulties when parties confuse export manager matters by using a sea freight term with an instruction to use air freight or deliver to an air freight forwarder at an airport or airport cargo centre.
If the shipper air freights a consignment of goods which have been ordered as “Free on Board UK airport” then risk which should pass to the buyer when the goods cross the ships’ rail remains with the seller as there is no ships rail point for the passage of risk from one party to the other.
1    Main carriage (or transportation) is the responsibility of the buyer who must nominate the carrier and be responsible for paying the freight costs from the named point in the country of departure to destination. By mutual agreement the seller can arrange the carrier and transportation but it will be at the buyers cost.
Real life example :  In the early stages of supplier/customer relationship it should be made clear who is nominating the carrier and equally export manager important identifying the place where the supplier meets his requirement for delivery under the contract of supply. All 11 Incoterms ® rules must be qualified by stating a specific place. In this example the supplier in northern England merely quoted his Japanese customer “FCA export manager … UK”. This led to confusion as to whether the goods should have been delivered at the suppliers cost to a freight terminal or whether the buyer of the goods was required to collect from the sellers premises. Either of these options is valid under the FCA term but must be agreed at the outset. Vagueness should be avoided in order to prevent argument.
2    Risk (of loss or damage ) transfers from the seller to the buyer when the goods have been delivered to the carrier at the named point. In the 2010 set of Incoterms ® rules published by the International Chamber of Commerce (ICC) the rules relating to loading were made more logical,  ie under “Ex Works” the seller has no responsibility for loading  whereas under FCA (Sellers premises) the seller does have to load.
Real life example:  Yorkshire exporter, failing to understand the loading obligation aspect of the FCA term, damaged the goods when unloading them at the nominated point which was a freight forwarders warehouse: by taking on a responsibility which was not incumbent under the term they found themselves liable for the damage incurred.  
The broad characteristics of each of the 4 groups contained within the new 2010 set of Incoterms ® rules apply to the terms contained within it, eg under “F” group terms as described above the main carriage will be paid by the buyer, risk will pass to the buyer at the named point as will costs. This consistency within the group is vital to an understanding of how the Incoterms ® rules system is meant to work.
It is, nevertheless, important to see the differences between the terms, with this in mind we will take a brief look at the 3 “F” terms to highlight their essential differences. First of all note that the FAS and FOB terms are intended export manager to be used only for “conventional” sea freight whereas FCA can be used for any mode of transport

The dispute was resolved when after considering the wording of Incoterms ® rules it was felt that handling related export manager to customs clearance and should be paid by the seller. Storage in the event of delays in consigning the goods should be to the buyers account as the forwarder is acting for the buyer.
